Our Chapter 7 Bankruptcy Practice
Under the recent revisions to the bankruptcy laws, you must now qualify to file under Chapter 7 by submitting to a "means test," whereby the court makes a determination of whether you have the ability to repay your creditors. We will confirm your eligibility to discharge your debts by walking you through the means test. We will also make certain that you understand, before you file, what debts cannot be discharged in Chapter 7, such as child support arrearage, student loans and some tax obligations. We will also ensure that any non-exempt assets, including principal residence, vehicle and retirement assets, are excluded from the sale. A Chapter 7 proceeding can also temporarily stop a home foreclosure proceeding.
If you qualify and decide to file for protection under Chapter 7, you will be required to participate in financial counseling. We can help you get the counseling necessary to go through the process. We will handle all matters related to the Chapter 7 filing, preparing and submitting any documentation required during the process, and representing you in hearings or meetings with the court, the trustee, or your creditors.
