Our Home Foreclosure Defense Practice
We offer clients a number of ways to avoid home foreclosure, including:
- Personal bankruptcy filing. Whether you seek to permanently discharge debts under Chapter 7 or enter into a reorganization or repayment plan under Chapter 13, filing for bankruptcy temporarily prevents a creditor from initiating or continuing any legal action based on a debt. You cannot discharge a mortgage through bankruptcy, but you may be able to buy enough time to get caught up. If you have enough equity in your home, you may be able to sell your home in the bankruptcy process and pay off all your other creditors. You may also be able to negotiate new mortgage terms that are more affordable.
- Home loan modifications. We can work directly with your lender to restructure or modify the terms of your mortgage, reducing the interest rate, extending the length of the mortgage, and rolling any arrearages into a refinanced amount.
- Short sale of your home. In some situations, we may be able to convince your bank or mortgage company to allow you to sell the property for less than the market value of the home and to discharge you from any further obligation on the loan. We don't actually negotiate the short sales, but use an agent to handle those often complex arrangements. However, if you short sell your home, you may have to recognize the amount forgiven as income on your personal tax return. We can help with those tax issues as well.
